Section 26 of the Act – Direct Residence
Section 27 – Residence on other grounds
7. Section 27(d) of the Act – Refugee Status
Asylum seekers who have successfully been recognised as refugees in terms of section 27(c) of the Refugees Act and who will remain refugees indefinitely, will be able to apply for permanent residence.
The requirements in terms of the Act are less onerous since they recognised refugees would have had to seek refuge in the most challenging of circumstances, and may not have their passports, birth certificates or foreign police clearances on hand per the normal requirements for residence.
