Circumstances

A foreign person who feels aggrieved by the conduct of the Department that has led to damages as a result of such conduct may wish to take civil action against the Department.

Our Solution

Smiedt & Associates will consider any prospective action against the Department and the extent of damages and sue the Department where the case is warranted.

In order to successfully sue the Department, there are two fundamentals, namely, the merits showing liability on the part of the Department, and second, the extent of the claim made against the Department.

Depending on the amount of the claim we would institute action in the Magistrates or High Court.
